Danville restaurant owners defy shelter-in-place order by continuing outdoor dining
Eliopoulos isn't the only Danville restaurant owner who resumed outdoor dining. Bernadette Moufarrej, the owner of Incontro Ristorante, also reopened her Italian restaurant and told NBC Bay Area that she felt confident her customers and staff could remain safe while dining outdoors.
"It has not been proven to us to show outdoor dining has caused an influx of COVID cases," Moufarrej told NBC Bay Area.
When asked in a recent press conference, Gov. Gavin Newsom declined to cite specific evidence showing outdoor dining contributes to the spread of COVID-19.
On Tuesday, Contra Costa County supervisors discussed the possibility of fining contra costa shelter in place offenders $20,000 — a move similarly made last month regarding lack of mask usage. Laurie Thomas, the executive director of the Golden Gate Restaurant Association, told SFGATE last week that outdoor dining has been “critical” to restaurants throughout the pandemic.

Five Bay Area counties to enact strict stay-at-home order ahead of state edict, starting Sunday
The regional action will apply in San Francisco, Santa Clara, Marin, Contra Costa and Alameda counties, and the city of Berkeley, the local health officials announced Friday. The order will take effect in Santa Clara, Contra Costa and San Francisco counties Sunday at 10 p.m. It will take effect contra costa shelter in place Berkeley and Alameda County on Monday at 12:01 a.m. Marin County will put the restrictions into place on Tuesday at noon.
This preemptive measure in parts of the Bay Area will close outdoor dining, personal care services such as hair and nail salons, playgrounds, bars and wineries, movie theaters, museums and zoos. It will allow retail, grocery stores and other businesses to remain open but limit capacity at 20%. Restaurants can do takeout and delivery only.
The restrictions are the same as those spelled out in the state order, which takes effect when regions dip below 15% capacity in their hospital intensive care units. Only now, they will take effect in the participating Bay Area jurisdictions a couple of weeks earlier than they would have. The order will be in place until Jan. 4.
“The dark COVID winter we feared would come has arrived in the Bay Area,” said Contra Costa County Health Officer Dr. Chris Farnitano. “I and other health officers don’t think we can wait for the state’s new restrictions to go into effect later this month. We must act swiftly to save as many lives as we can. This is an emergency.”
The state order divides California into five regions to measure whether each region drops below 15% ICU capacity — Northern California, the Bay Area, Greater Sacramento, San Joaquin Valley and Southern California.
The Bay Area region, which under the state mandate includes Santa Cruz and Monterey counties, is currently above the 15% intensive care discover online banking bonus hospital bed threshold that triggers the state-mandated stay-at-home order, with 25% of ICU beds available.
But Santa Clara County is in particularly bad shape, with only 14% of ICU beds available, according to county data. The six Bay Area jurisdictions are voluntarily moving forward with the regional order to help stifle the recent, steep rise in new coronavirus cases.
The six Bay Area jurisdictions decided the 15% state trigger was not fast enough and that the region needed to take action earlier, the health officers said Friday.

“We need urgent intervention now to dent the trajectory of this surge,” said Dr. Grant Colfax, director of the San Francisco Department of Public Health.
The number of COVID-19 patients in Bay Area ICUs hit a record high 263 on Thursday, surpassing the previous record of 261 on July 29. That ICU number has increased 40% over just the past week, and tripled in one month.
The region hit a record in hospitalizations last week. Currently, 933 people are hospitalized with COVID-19 in the Bay Area. Just over 90 people are hospitalized in San Francisco, and Colfax said that number is expected to double by Jan. 4. He said that by Feb. 4, 1,600 COVID-19 patients may need hospitalization if the current trends hold.
“And across the region, some counties, including Santa Clara, will run out of ICU beds in the next week,” he said.
San Francisco currently has 26% of ICU beds available. Health officials say if the current trajectory of case increases continues, the city would run out of ICU beds on Dec. 26. And they already are expecting a significant uptick in patients over the next few weeks due to Thanksgiving gatherings.
“We hope these urgent interventions can stabilize our case counts,” Colfax said. “If we move today we can keep our health care system functional and save lives. We cannot let this virus get so far ahead of us that we cannot properly care for the ill and vulnerable in our community.”
The Bay Area stay-at-home order will remain in place for nearly a month at least, which is longer than the three weeks mandated by the state order once regions fall under it. Colfax said the local order will be lifted if the counties see a “consistent decrease” in the rate of new coronavirus cases contra costa shelter in place hospitalizations for three weeks. The counties also need to have at least 25% of ICU beds available, he said.
About 12% of cases end up in the hospital. Of those, about 25% to 40% end up in the ICU, estimated Dr. George Rutherford, an epidemiologist at UCSF.
Public health and political leaders said they recognized that the timing of this stay-at-home order is especially brutal, given the holiday season and people’s understandable desire to gather, plus their exhaustion with living under the threat of the virus.
But this could be the final wave, they noted, with a vaccine on the horizon and an end to the pandemic in sight.
“This should be the last major surge we face, and it will likely be the most challenging because we’re tired of this. I’m tired of this,” said San Francisco Mayor London Breed. “This is perhaps the final test we face as a city in this pandemic. We need to do what we can.
“People will die otherwise who would have lived,” she said.
As news of the impending closure of outdoor dining spread, some restaurant owners tried to take the development in stride. Dylan MacNiven, who owns Woodhouse Fish Co. in San Francisco, said he was glad to have at least a couple of days notice — unlike the last closure of outdoor dining at the beginning of the pandemic, which forced him to throw away a lot of food and produce.
But he worries about whether restaurants can american savings bank home equity loan this next, prolonged closure without federal assistance.
“Restaurant people are naturally scrappy, but unless there’s some sort of big federal package, I don’t see how a lot of people won’t default on their loans, their leases or their tax bills,” he said.
Four Bay Area counties are not participating in the regional order: San Mateo, Napa, Sonoma and Solano.
“To add orders on top of what the state has already issued restricts local businesses even further when they are not the cause of spread in Solano County,” said Jayleen Richards, public health administrator for Solano County, which has 35% ICU capacity remaining. “The primary contributor of spread in Solano County is personal behavior and people gathering with others outside of the household without following safety measures, like masking and physical distancing. We do not want to cause even more hardship to our local businesses.”
Napa County is not implementing any earlier or more stringent stay-at-home orders than what the state has done, said public information officer Janet Upton. The county expects to fall under the state stay-at-home order in mid- to late December.
“While the county understands and appreciates the measures taken by the other Bay Area counties, San Mateo will not at this time be issuing a new, local stay-at-home order and will continue to work with business and community leaders on adherence to existing guidelines,” San Chase bank number to call County said in a statement.
In Santa Cruz County, county spokesman Jason Hoppin said in a statement, “We are aware of the decisions of the Bay Area counties to implement the Governor’s stay-at-home order immediately rather than wait for the state criteria to be met regarding ICU capacity. In collaboration with county leadership, Santa Cruz County Health Officer Dr. Gail Newel is considering what additional measures may be necessary to protect the health and safety of local residents. At this time, we have not reached any conclusions but are considering all options.”
Dr. Nicholas Moss, the Alameda County health officer, said he understood that many people would be frustrated by the new mandate. “I think it’s going to be heartbreaking and angering for a lot of people. After asking for so much already, we’re asking for even more,” he said.
“We think the state’s plan is great, but it means waiting too long,” Moss said. “I would love to be wrong. But I look at the numbers every day and we are just going up, up, up. Where does it stop? We need to take action now.”

What Does ’Shelter in Place' Mean? Here’s What Life Is Like Under the Mandate
COVID-19, which has killed more than 8,000 people as the disease sweeps across the world, has prompted cities and areas everywhere to take action, ordering quarantines and lockdowns in an effort to keep people indoors and curb the spread of the coronavirus.
On Thursday, California Gov. Gavin Newsom announced a statewide “stay at home” order in an attempt to prevent the further spread of COVID-19 in the state. The move, which asks all Californians to remain at home unless they have essential reason for going out, comes after officials in the Bay Area introduced some of the U.S.’s most stringent restrictions by announcing a “shelter-in-place” mandate on Monday. Since Tuesday, affected Bay Area residents have been required to stay inside and can go out only for necessities. For now, the mandate, which affects nearly 7 million people across six counties, will last for three weeks, until April 7.
“This is a critical intervention to reduce harm from the spread of the coronavirus in our community,” reads a guide to the mandate from the city of San Francisco. “This is a mandatory order.”
Residents in the counties of San Francisco, Santa Clara, San Mateo, Marin, Contra Costa and Alameda have been ordered to shelter in place. Santa Cruz County is also under lockdown until April 7, and residents have been ordered to shelter in place. On Wednesday, public health officials in Colorado’s San Miguel County also ordered a shelter-in-place mandate, prohibiting gatherings of more than 10 people, among other rules.
One Bay Area resident says the mandate has been impactful because it forces people to actively monitor and change their behavior to keep others safe.
“We have to be mindful about giving people space,” Angela Hockabout, an Alameda County resident, tells TIME. “Everyone is trying to get used to it.”
Here’s what to know about sheltering in place, and what you can and cannot do.
What is shelter in place?
Essentially, sheltering in place means staying at home, the order from San Francisco’s Department of Public Health says. Nearly 300 cases of COVID-19 have been confirmed in the Bay Area, as well as at least three deaths, according to the department.
“Widespread testing for COVID-19 is not yet available but is expected to increase in the coming days,” the mandate says. “This order is necessary to slow the rate of spread.”
People should stay in their homes unless they need to leave for “essential” activities and work. The mandate went into effect on March 17 and will continue until at least April 7.
The order details that violating the mandate is a misdemeanor punishable by fine, imprisonment or both. The San Francisco Police Department tells TIME that actively enforcing the order to ensure people stay inside is a “last resort.”
“We want people to use common sense and to think about how their actions can put others at risk,” says Robert Rueca, a spokesperson for the San Francisco Police Department. “Voluntary compliance is our goal and most of the city seems to be responding.”
On the East Coast, the concept of “shelter in place” has been the subject of debate between New York City Mayor Bill de Blasio and New York Gov. Andrew Cuomo. After de Blasio indicated on Tuesday that New Yorkers might soon be ordered to shelter in place, Cuomo argued against using that particular turn of phrase to describe the current situation.
Restrictions similar to those in the Bay Area have been enacted in New York — like requiring businesses to keep at least 75% of their workforces at home and closing restaurants, movie theaters, gyms and other places where people gather in large numbers. But Cuomo said a phrase like “shelter in place” recalls rules from the Cold War era and could be frightening.
“‘Shelter in place’ is a scary term for people,” Cuomo said during a news conference on Thursday. “I believe communication is important, and I believe words are important. Say what you mean and don’t say what might alarm people.”
What does a shelter-in-place order prohibit?
In the Bay Area, the mandate prohibits going outside, with certain exceptions for different groups of people. Vulnerable people, which include the elderly, minors and people with disabilities, should not go out at all, according to the order. Anyone who is at risk of severe illness from COVID-19 is also urged to stay inside.
People are barred from gathering outside the home. To that end, all restaurants, bars, cafes, nightclubs, gyms and recreation facilities have been ordered closed. Places that serve food can continue delivery and takeout services.
All travel is prohibited — including walking or biking places, taking a car, scooter, or motorcycle on the road, or using public transit — unless classified as “essential.” Anyone who has a job that is not considered “essential” should work from home.
Who is exempt from a shelter-in-place order?
The Bay Area mandate details several exemptions from the shelter in place order. People can leave their house for “essential activities,” which include getting medical supplies, going to the doctor or getting supplies needed to adequately work from home. They can also go out to get groceries.
People can also go out to run, walk or hike as long as they maintain the requirements of social distancing and stay at least six feet away from other individuals.
Those whose work is considered “essential” are also permitted to leave the house to continue their work. Essential businesses include health care facilities, grocery stores and other food markets, banks, media services, hardware stores, laundromats and delivery services, among others.
The homeless population across the Bay Area counties is not subject to the order, though it is not clear what those experiencing homelessness can do to properly shelter themselves. The local government has urged unhoused individuals to “find shelter” and told agencies to “take steps needed to provide shelter,” according to the order. More than 150,000 individuals are homeless in California. State Gov. Gavin Newsom said Wednesday that he would spend $150 million in an effort to protect the population — the money will be used in part to boost services for the homeless and to buy trailers and lease hotel rooms to house people.
What does life look like under a shelter-in-place mandate?
For Lindsey Parker, the co-CEO of the Dog Social Club Cooperative, a dog daycare and boarding center in Alameda County, the shelter in place mandate has changed everything about her day-to-day.
Parker is currently sheltering at the dog daycare facility, and using her office as a bedroom in order to continue taking care of the pets of frontline workers battling COVID-19, such as doctors and other healthcare professionals. At the moment, Parker is helping to care for at least 10 dogs along with a coworker and her coworker’s husband.
“It’s funny to wake up and walk downstairs to feed the dogs. There’s no going home and Netflix-ing,” Parker tells TIME as she plays fetch with a dog.
While the Dog Social Contra costa shelter in place is not itself an essential business, under the mandate, Parker can still provide services for workers whose jobs are considered essential.
“We want to be here to serve those people,” she says. “It’s a big resource to enable people to do their jobs well, and if we can support the greater problem in that way, that means a lot.”
At Angela Hockabout’s home in Alameda, Calif., the shelter in place mandate has a range of people staying in one house, including Hockabout, her husband, her 79-year-old mother-in-law and her two children, aged 10 and 8. Since being ordered to shelter in place, Hockabout says she’s noticed a personal transition.
“People should know there’s shock you experience when anything in your life changes overnight,” she says. “This is really scary, and I’ve been having panic attacks. It’s really real. Be gentle with yourself and allow yourself to feel your feelings.”
The mandate has clarified for Hockabout that people really do need to stay inside, and if they do go out, to adhere to the social distancing requirement of staying six feet apart from each other. While she’s glad the government has stepped in to stop people from going out in large groups, Hockabout says people need to do more. Her mother-in-law, for example, keeps running to answer the doorbell when people come by to drop off or pick up supplies — which is not ideal when older people have been told to protect themselves.
“I’m like, ‘lady, you should not answer the door,'” she says. “We need to prevent this contact as much as possible.”
Other Bay Area residents have practiced the mandate’s stipulations well before the government announced the order. Mary Jeanne Oliva, 70, and her husband, Stephen Estes, 69, who live in Santa Clara County, say they began self-isolating four days before the mandate was implemented. For Oliva, being alone has meant an increased use of social media.
“I’m an extrovert, and I miss hanging out with people,” she says. “I’m doing three times more on Facebook and the internet than I normally do.”
Estes, a senior systems analyst at Stanford University, has been working from home for basically all of March in an effort to be cautious. “We know we’re like, 70 years old, and susceptible,” he says.
For the couple, the main concern is the economic downturn caused by COVID-19. Estes says he’s keeping an eye on their 401k and 403b savings accounts to see how they’re impacted by a decline in the stock market.
“The tradeoff between safety and economic recession is very tough,” he says. “The only thing I can see to help us through this is to get used to the fact that we live in a hazardous environment.”
