TORONTO — TD Bank Group's U.S. subsidiary has settled a lawsuit it filed against a data aggregator it accused of using the bank's logo to trick users into handing over personal data that can later be monetized.
Judge Renee Marie Bumb says in an order filed in a New Jersey court that the case TD had against Plaid Inc. has been dismissed and both parties have been ordered to cover their own costs.
Documents filed ahead of the order show the bank requested a dismissal because the matter had been settled "amicably."
The case began last October, when TD filed a lawsuit that accused Plaid of creating a user interface for financial services applications that infringes on the bank's trademarks, logos and green colour scheme.
The bank argued that Plaid's interface “dupes” consumers into believing they are entering personal information into TD Bank's trusted platform.

TD Bank Group shares rise as it reports $3.8B Q4 profit, raises quarterly dividend
TORONTO — TD Bank Group shares climbed almost five per cent Thursday afternoon after the bank reported fourth-quarter earnings that surprised to the upside and it raised its dividend by 13 per cent.
The bank's stock closed up $4.52 or 4.91 per cent at $96.50 on the Toronto Stock Exchange, boosted by a combination of its results and a wider market rally.
TD reported a rise in earnings in part from its U.S. division where it saw higher margins on loans, while Canadian retail banking also inched up amid increasing client activity and credit card spending.
"We have strong customer activity that is driving volume and revenue growth, and we feel very good about that," said Kelvin Tran, chief financial officer, in an interview.
The bank said Thursday it will now pay a quarterly dividend of 89 cents per share, up from 79 cents per share. TD also says it plans to buy back up to 50 million of its shares.
The decision came after the federal banking regulator lifted restrictions last month on dividend increases, share buybacks and increases in executive compensation that were put in place at the start of the pandemic.
TD reported a net income of $3.8 billion in the fourth quarter, down 26 per cent compared with last year when its earnings were bumped up by the sale of its investment in TD Ameritrade. Adjusted earnings were $3.9 billion, up 30 per cent from last year.
On an adjusted basis, TD says it earned $2.09 per diluted share, up from an adjusted profit of $1.60 per diluted share in the same quarter last year.
Analysts on average had expected an adjusted profit of $1.96 per share, according to georgia power business pay bill markets data firm Refinitiv.
Scotiabank analyst Meny Grauman said in a note that the estimate beat was notable because other Canadian banks so far have missed.
"In a sea of misses not only is an [earnings per share] beat refreshing, but is likely to stand out on earnings day."
He said that while the quarterly results are positive, for the year TD had much more modest financial gains and the question now is how sustainable the results from the quarter are going forward.
Barclays analyst John Aiken said in a note that a good portion of the earnings beat was from lower than expected provisions as the bank reported a $123-million reversal of its provisions for credit losses.

TD Convenience Checking might be suited for those who aren't looking for an account to earn interest and typically don't keep a high balance in their account. The $15 monthly maintenance fee is waived if you keep at least $100 in your account balance or are between the ages of 17 through 23. There's also no minimum amount to open an account.
TD Beyond Checking has no monthly maintenance fees if you do one of the following: get monthly deposits of $5,000 or more, have an average daily balance of $2,500, or have a combined total of $25,000 across eligible TD Bank accounts. Otherwise, you'll be required to pay the $25 monthly bank fee.
Other noteworthy perks include free basic checks and reimbursement of up to two overdraft fees a year. Also, any fees incurred with a rush bill payment will be covered. You'll also get reimbursed for fees tacked onto one outgoing wire—domestic or international—per statement cycle. However, you'll probably be able to find a higher APY elsewhere as the rate is 0.01%.
If you're looking for a no-frills checking account, the TD Simple Checking has a $5.99 monthly maintenance fee no matter how much you have sitting in the bank. You get just the basics with this checking account, such as free online statements and free access to TD's mobile bank app.
Young folks between the ages of 17 to 23 are eligible to open a Student Checking account. TD Bank's Student Checking features no minimum balance and no monthly maintenance fees. The no-account fee bleeds over to a linked Simple Savings account if you're age 24 or under.
For those 60 and up, TD Plus 60 Checking features free checks, statements, and money orders. Also, the $10 monthly maintenance fee will be dropped as long as you keep an average daily balance of $250.
Money Market Account
The TD Growth Money Market Account offers a rate bump if you set up a monthly recurring transfer of at least $50 from an eligible TD account. While there's a $12 monthly maintenance fee, you can skip the fee if you do one of the following:

TORONTO — TD Bank Group's U.S. subsidiary has settled a lawsuit it filed against a data aggregator it accused of using the bank's logo to trick users into handing over personal data that can later be monetized.
Judge Renee Marie Bumb says in an order filed in a New Jersey court that the case TD had against Plaid Inc. has been dismissed and both parties have been ordered to cover their own costs.
Documents filed ahead of the order show the bank requested a dismissal because the matter had been settled "amicably."
The case began last October, when TD filed a lawsuit that accused Plaid of creating a user interface for financial services applications that infringes on the bank's trademarks, logos and green colour scheme.
The bank argued that Plaid's interface “dupes” consumers into believing they are entering personal information into TD Bank's trusted platform.
Plaid denied trying to trick users into handing over personal information and said it was caught off-guard by the lawsuit because it had been working to resolve the issue with the bank for quite some time.
TD spokeswoman Lynsey Wynberg and Plaid spokeswoman Claudia Lo confirmed a settlement was reached, but declined to share its terms.

Does TD Bank Offer Free Coin Counting Machines?

TD Bank, coined as America's Most Convenient Bank, does not provide coin-counting machine to customers.
Previously, the bank was popular because it did offer the "Penny Arcade" coin-counting service, but it has been suspended due to reports that it was shortchanging users.

How TD Bank Customers Can Deposit Coins
In order to deposit coins, TD Bank customers will have to use coin wrappers. These wrappers are available for free by visiting a TD Bank branch.
Tip: Most banks will give you free coin wrappers.
Customers have to wrap their coins at home before bringing them in for deposit.
This is the standard procedure adopted by most other banks that don't offer coin-counting machines.
Where You Can Still Find Coin Counters
Although TD Bank doesn't offer coin-counting machines, other banks may provide them.
However, you'll most likely have to pay a fee (a small percentage of the amount counted) if you're a non-customer. Some banks won't even let you use the machines as a non-customer.

History of TD Bank Penny Arcade Machines
In 2008, Canadian-based TD Bank acquired Commerce Bank and since then has kept most perks, such as being open 7 days a week, allowing dogs and offering dog treats.
The Penny Arcade machine was a coin-counter that allowed anyone (even non-customers) to count their coins.
Users were allowed to guess the total value of the coins.
If guessed within a certain range of the correct amount, users would collect a small prize when they took the receipt to a TD Bank teller.
Meanwhile, users could cash out the coins or have them deposited into a TD account.
In November 2015, TD Bank started charging non-customers to use the machine. An interesting decision by TD, as the service drove over 6 million non-customers a year to TD branches.
Mixed response to the fee changes
If you are like us, you know counting change can be annoying. This is why TD Banks decision to begin charging non-customers is kind of a bummer.
The service, which was free-for-all, started to come with a 6% fee for those who don’t have a TD account.
One comment read: “I am a customer of TD and it never made sense to me that non-customers received the same convenience at no cost to them.
If they want the service for free then they should bank with them. I am sure their bank doesn't provide free coin counting.
TD is a fantastic bank and not a non-profit and the bottom line is coin-counting machines and the processing of the coin is expensive! All you have to do is be a customer!”
While this move to charge have upset non-customers who use the service every year, TD Bank felt is was the best decision for their current customers.
When asked why the change was made, a spokesperson for the bank indicated that a number of customers and employees were complaining that non-customers who use the machine were negatively impacting the service (Source: American Banker).
Penny Arcade machines removed entirely
TD removed the coin-counting machines from all branches in May 2016 because customers were complaining that they were being shortchanged.
Allegedly, the machines counted coins inaccurately. Customers counted the coins before putting them through the machine and discovered that it was consistently recognizing less money than it should.
